No, you won't be violating the rules just by forming the LLC. Anyone can form an LLC, including foreigners here on a visa. The problem arises when you want to work for the LLC you've formed, which you cannot do under your current visa status. So as long as you want to form it to do business in the future (or get another person to work for it/manage it), you are ok visa-wise.
