Probation Violation Warrant in NC
Anonymous1 views3 answers
I have a probation violation warrant in NC, with a suspended sentence of 1 year. I have been gone for almost a year, but haven't gotten into any trouble.
I want to take care of the warrant in NC, by paying all fines I owe and turning myself in. My probation term was for 2 years, which they extended for another 6 months to give me more time to pay my fines. I completed the original 2 year probation term with no violations (passed all drug tests, went to all appointments, always home by curfew, etc.) I just needed to move somewhere that has better job. Anyway, I just want to know the best way to handle the situation. Should I get a lawyer and how much would it cost?
You should contact an attorney to negotiate on your behalf. Absconding supervision is taken very seriously by the court. Many times it results in revocation of probation, requiring you to serve your prison term. Having all of your fines and monies due when going to court might mitigate that in your situation. All attorneys set their own fees, so I cannot tell you what it will cost. Get a recommendation from someone you trust about the best attorney for you to use. Don't just go with the cheapest, your liberty is at stake.

I agree with Mr. Sullivan. You should gather enough money to pay all of your court costs and fines, and then hire an attorney to represent you (and hire someone that is experienced and that comes with a meaningful recommendation). Your attorney will get your case put back on the docket (likely on a Friday, as that is when Durham Court typically hears probation violation cases). When you go to court, be prepared to be taken into custody by one of the bailiffs when your name is called by the District Attorney. It is not guaranteed that you will be taken into custody, but it often happens when a warrant exists and the person subject to the warrant shows up to court.
If you are looking for a recommendation for this case feel free to contact me directly. You can obtain my contact information on my avvo profile or by visiting my website at www.kregerthacker.com (I won't be recommending myself, as you will be better with someone with much more experience).
Just one clarification/addition to the above answers-Durham typically hears misdemeanor probation violations on Fridays. Felony probation violations heard in Superior Court have calendar call on Monday morning and the cases are usually heard later Monday or Tuesday.
