How can I help my friend, who is a Stay-At-Home mom, divorce her emotionally abusive husband w/o being scared of eviction ect.

My friend is looking to get a divorce but feels trapped and scared due to things such as: No Job, No family to lean on, No personal assests i.e car or savings, Comments the husband has made, Only has a high school education. Her situation: Been married for 1 year. Daughter is almost 2. They rent a trailer house in California, and the husband works in Nevada. She is a stay at home mom, and takes care of her daughter 24/7. They both love the daughter. They are planning to move to Nevada to be closer to his job very soon. She has lost feelings for him slowly due to his controlling nature. She has been scared to communicate it to him. She is not sexual with him and he has mentioned divorce over it. Comments such as “If you ever cheat I will kill you.” and “If we ever divorce I am getting full custody.” Her priorities are to have joint custody, and be left with enough to do that. She is looking for a part time job to help her case and gain income. He is not aware of her intentions to divorce. Can he kick her out? Does being a low educated and unemployed hurt her chances at custody? Does she have a right to financial support and marital property? Thank you for any advice!

I saw your post come through on . We just published a very lengthy article on ending short-term marriages that your friend might find helpful. The biggest issue she is going to have is jurisdiction. If the child has lived in CA, she may need to file in CA. If they move to NV, she can likely file in NV but it can get complicated. Your friend should talk to an attorney if at all possible to go over all of the possibilities. Our article is here: http://rosenblumlawlv.com/the-definitive-guide-for-ending-your-short-term-marriage/ It might give her some answers to her questions.
