Witness and attorney....are they the same?
Anonymous2 views2 answers
We signed a contract (after marriage)in a law office, that was witnessed by the same attorney.Would this contract be of any value, since we had the same "witness".
As the issue of seperation is coming up,and the contract states nothing will be parted to the other party if such a event occurs, will this be so?
Secondly, experiencing of verbal abuse, what would be the situation if a complaint is made to the police, since my kids and me have no where to go or would it be advisable/safe for us to get an attorney?
(As informing the police may make matters worse for us,as this can get him even more raged). What is the best suggestion pls.
Not sure of all of the substanive intracacies of the contract, but 99 times out of 100 there is nothing inherently wrong with an attorney being a witness or even being a witness to two people on the same document. If you are looking for an interpretation of a prenuptial agreement that goes beyond a brief internet posting and an attorney would have to look at the actual document and reviwe you present circumstances. The same would go for the other question.
This answer is offered for informational purposes only. It is not offered as, and does not constitute, legal advice. Laws vary widely from state to state. You should rely only on the advice given to you during a personal consultation by a local attorney who is thoroughly familiar with state laws and the area of practice in which your concern lies.
I do not see a problem with the attorney testifying that each of your signed the document in his or her presence. But, as this would not appear to be a fact in dispute, the testimony to that effect may not even be necessary.
