Handicapped parking ticket

2 views 4 answers
I parked in handicap parking space because I didn't see the signs in New Jersey. It was night and the sidewalk was covered with snow so I stopped the car let two of my friends riding with me out and the parked and got out. Nobody saw the signs. I have to go to court but this is my first ticket ever. I read that I can be convicted to community service. So I guess my question is if I need a lawyer with me and if my friends should come with me to court as witnesses

You certainly should hire a lawyer to represent you. A lawyer will be able to present a defense for you, and give you the best chance of having the penalties/charges reduced or even dismissed. Contacting a lawyer should be your first step, but I'm sure the attorney would use your friends as witnesses as part of your defense. Make sure that you hire an attorney that has experience with traffic infractions. Many attorneys have free consultations to evaluate your case and let you know what they think your chances of success are. Best of luck to you.

A lawyer certainly would help you succeed but the cost would be greater than the fine if you lost. Edison is a very reasonable town. I suggest that you go down and talk to one of the prosecutors and see what they are offering or if they will accept your version. Bring your witnesses. If they do not budge you can usual get a short adjournment to hire a lawyer if you wish.

Mr. Cheser's advice is spot on. Having a lawyer with your would definitely help, but will cost you more than the fine. Politely and calmly speak with the prosecutor and explain what happened and you may be able to resolve the matter on your own. If not, and you decide you want a lawyer the court will give you time to retain one.

My New Jersey Colleagues are correct. Just for your information, the statute mandates the fine for a first offense is $250. There are enhanced penalties for a second and subsequent offense of $250, and/or up to 90 days community service (N.J.S.A. 39:4-197(3)c). Even though it was dark and snowy, that may or may not persuade the prosecutor-and many Judges take a hard line with this offense. There are no points associated with this violation. Good Luck!
