Can I get charged?

4 views 2 answers
My boyfriend is in custody due to domestic violence. The judge and DA issued a criminal protective order with no contact against him. He's called plenty of times but I refused his calls. Recently my brother passed away and my father is gravely ill. Needing all the support I can he heard the news called me and I answered his phone calls. Couple of days later I contacted the DA because I was subpoenaed to show up to court to testify against him she then proceed to ask me if he has made contact I lied and said no because i thought i was going to get in trouble for violating the order. Now that I found out that I wont get in trouble for answering his calls I am worried that I will be charged for lying to the prosecutor. I am also worried that it will be brought up in court. What should I do? I am going through a tough time right now and I'm currently looking for mental health.

I strongly suggest contacting an attorney. If you lied under oath, technically that is perjury. However, being a former prosecutor, I have never seen a victim be charged with perjury under these circumstances, and I'm not sure if you were under oath (it sounds like this was a phone conversation). Either way, it would be wise to consult with attorney so that your attorney can contact the DA.
