Many questions need to be answered before we can determine how defensible your case is. What caused the crash? Were there any witnesses? Were you already in the ambulance when the police contacted you? Did you admit to drinking to the police or the paramedics? Were there any tests preformed? Jail time is rare but not unheard of in first time DUI cases with low test results, and 10 days are required if there is a test result over a .2ml per 100ml of blood. Contact a local attorney asap. Your question does not have a simple and quick answer. What you have working for you is that this is a 1st offense. It is unlikely you will escape any penalties, but there are ways to get jail time suspended or converted to things like probation, house arrest, etc. Your best course is to discuss your case with an attorney.
