Can I move out from South Dakota to Texas with my child?

Business Questions 5 views 2 answers
I have full legal and physical custody of my child in South Dakota, and wanting to relocate, I see nothing in my court order stating a regional restriction or anything of that nature, do I need to give notice or am I just free to go as I want?

Are you sure you have full custody and not primary physical custody? Full custody usually means that the other parents' rights have been terminated. If you only have primary physical custody, the law requires you give notice, in order to allow the other person to object. If he or she objects, you must set a hearing, provide notice, and get a judge's permission to relocate.
