Summary Offense in PA

2 views 3 answers
I know summary offenses are punishable by up to 90 days jail and/or $300 in fines. My question is, what is the normal outcome? Is it normally a fine? Is it common for someone to be sentenced to jail for a non-traffic summary offense and if so which summary offenses does this normally occur with?

It is impossible to respond to what is "normal" as there is no such thing. There are many things which impact sentence including prior offenses, the type of offense and the particular mindset of your Magisterial District Judge. However, it would be unusual for someone to receive a jail sentence for a first time summary offense.

In 21+ years of practice I have seen one or two defendants sentenced to jail on a summary and they were both repeat offenders with nasty attitudes. But whats normal? Well thats hard to say.
