What are my chances of success if I file a lawsuit for assault and battery? Would it be worth it?
Approximately 3 months ago (November 2017) I asked an individual to move their parked vehicle off private property next to a lake where they were fishing. The individual became irate and started cursing at me. We both got into a shouting match as far as yelling back and forth. He then approached where my vehicle was parked next to his. I thought that he was reluctantly going to move his truck, but instead he ran up to me and punched me in the face twice, knocking me backward onto the ground after the second punch. He then called me a f*cking p*ssy and got into his truck and left. I staggered away to avoid further conflict and called the police. As a result, I suffered a bruised jaw, bloody lip, black and blue around my right eye and had a headache for the next 2 days afterward. Right now I feel alright and have not had other problems medically since the incident. I missed 1 wk of work. This guy was 25 yrs. old and was charged with assault and battery. The police tracked him down after I manged to take a picture of his license plate. My health insurance covered the cost of my care which included x-rays of my jaw to ensure it wasn't broken. Should I sue or is it not really worth it?
