I am under a j1 student visa ( no two year requirements) and just graduated my paperworks are in order but I do not want to go back in my country as it's relatively unstable. There is no direct threat to myself as person but the political environment is very bad. I have been here for more than a year. Can I file for asylum?

You can apply for asylum, but you will have to prove that you have "a well-founded fear of persecution" based on your (1) race, (2) religion, (3) politcal beliefs; (4) nationality or (5) membership in a particular social group.

I agree with the above response. It is also important to know that an asylum claim MUST be true. Filing a fraudulant asylum claim will prevent a person from ever lawfully returning to the U.S, even if they have a U.S Citizen relative petition. It is a permanent ban. If you do feel that you are eligible for asylum becasue of your well-founded fear, you would benefit from working with an attorney who can help you prove your case. Andre Olivie, Esq. Since you have been in the US for more than 1 year (I'm assuming) you will have to file for withholding of removal unless you can show that circumstances in your country changed in the last 12 months. Furthermore, in order to file for asylum you must show that YOU will be persecuted based upon a protected category. It's a very high bar & you should not file unless you objectively & subjectively believe you will be persecuted. Asylum is a very sophiticated concept. You should consult an attorney to analyze your case.
