Rental Agreement 30 Day Change Notice Vs Immediate Signed Addendum

Landlord Tenant 1 views 2 answers
Washington State Law requires a 30-day notice for changes to a month-to-month rental agreement, such as increases in rent. How about an agreed upon signed addendum for a change that goes into effect in less than 30 days? if an addendum for changes is presented by the landlord that is signed by the tenant for changes to the rental agreement within less than 30 days, is that legal?

A lease is a written contract. A contract requires three things, an offer, acceptance, and consideration. In other words, the two parties are making an exchange for value to each party. Does the addendum provide BOTH parties with value, or just the landlord? IIf both of you are receiving a benefit (not being kicked out is not a benefit), then you are OK. What is the tenant getting for agreeing to sign this addendum? If they aren't receiving a benefit, the addendum probably isn't enforceable and will be a pain in the butt for you if your tenant decides not to abide by it. Why take the risk? Its just 30 days.

It doesn't appear to be illegal, but if the tenant refuses to agree to the rapid rent hike, then wouldn't it keep the existing rental amount in effect? Why wouldn't the landlord give more than 30 days notice like the spirit of the law says to do? Why try to find some sneaky loophole? Is the landlord's honor worth less than a few dollars?
