If this has been entered onto your computer record, that is, the CII at the California DOJ or the NCIC at the FBI, it will probably stay there forever. That record would be available to law enforcement and other governmental agencies (or entities related to governmental agencies, like banks, casinos and FINRA). However, I do not know if this has been entered in the computer record. You can get a Livescan and pay $25 (I have been saying $10 but the up to date and perceptive Mr. Kaman indicates the cost has gone up) and you can see what is on your DOJ, CII rap sheet. Meanwhile, ordinary employers do not have the authority to pull your CII or NCIC rap sheets. they would be obligated to do a private background search which is hit or miss. So they may, or may not find your records in the County Courthouse or through other public access databases. Having said all of this, you really need to talk to an attorney. Take whatever paperwork you have in to see the attorney. She or he should be able to tell you if there is a basis to believe that there may be an entry in CII or NCIC. She or he can also talk to you about any way to remove the reference from the computer, if it is there to start with. Good luck!
