I have a friend who entered the US in 2000 legally from brazil but their visa expired. They are still here, what are their options to stay in the US? If they get married to an American, what are the next steps?

If they enter a bona fide marriage with a US citizen they should be ok. The steps after that depend upon a number of factors and are quite complicated. I suggest they speak with an immigration attorney for more details. My firm is experienced in spousal based immigration petitions.

If your friend marries a U.S. Citizen, he/she may adjust status to lawful permanent residence because the entry was done with a visa. It is important that your friend does not leave the country because he/she would be subject to a 10 year bar to reentry to the U.S. because of unlawful presence for over 1 year. Your friend should consult with an immigration attorney to go over any available options. Seeta L. Nangia, Esq. Is your friend currently dating someone? It is very very important that any marriage be genuine as marriage fraud will lead to deportation and jailtime and/or fines for both parties. The marriage adjustment process requires filing several forms and providing evidence of a genuine marriage and also financial and medical documents. If your friend does plan to marry a U.S. Citizen, he may call me for a free consultation at (206) 724-1940. Andre Olivie, Esq. http://s2.webstarts.com/olivielaw/
