i got caught at walmart taking 40 dollars worth of cds. they told me they weren't going to press charges on me or put me on tresspassing for it because i didnt run. they were very lienient on me. thank god. Is it possible to get off with probation rather than jailtime?

I have never had a person get jail time for a first time shoplifting, if they had a clean record. If Walmart said they were not going to arrest you, they may still send you a civil letter requesting payment. Talk to local criminal attorney and see what programs they have for first time theft offenders if you are charged. Some judges will give some jail time even on first offenses.
