In 2003 I was charged with a felony. Did my deferred judification...no problems since. It is now 2011 and I want to make sure my record is sealed..Please advise!
Thank You,
Regina
I would suggest two things you should do. First, check with your attorney to make sure that the record was supposed to be sealed as part of the disposition of your case. Getting a case dismissed is not the same as getting the record sealed. Second, if the record is supposed to be sealed, contact the clerks office of the court where the felony case happened and ask them whether your conviction is a public record. Third, pay a service to run a background check on yourself to see what appears on your record. This way, even if the clerks office says the record is sealed, you can double-check to make sure the information is not being distributed anyway. Every once in a while, a person whose record is supposed to be sealed will slip through the cracks.
You can't "make a deal" to have your record sealed. You must have filed a petition to have the record sealed and gone to court for the petition to be presented to the trial judge. If you have not done this, then your record is not sealed.
To check if it is sealed, go to the district clerk's office in the county in which you received the deferred and check for the file. If it is sealed, the clerk will not be able to find the record to give to you.
