When can I file Motion for Summary Judgment?

I requested Defendant to produce documents as part of discovery. No documents are produced during 2 months. Can I move court for summary judgment or I have to file Motion to Compel Discovery first? Thank you.

You will have to file the motion to compel. However, you will first need to serve the defendant with a letter stating that the discovery is outstanding and that you will be filing a motion. It is called a good faith letter and is required by most courts. I would need more informaiton to provide you with an opinion. If you would like, please fell free to call my office and I will discuss this matter with you at no cost. You can also email me at [email protected]

As an Atlanta business litigation lawyer, I would not only file a Motion to Compel, but a file a Motion for Sanctions against the opposing party and their counsel to recoup the attorney's fees and cost of being forced to litigate to acquire documents that should have been handed over long ago. In Georgia, the local rules require you to send the non-responsive party a letter requesting that they respond to the discovery. if they still do not file a response, you file a Motion to Compel where you can also ask that the court strike their Answer and provide other remedies.
