Arrested without evidence

3 views 2 answers
If i was arrested without any kind of evidence on contributing to the delinquency of a minor, sworn testimony from 3 people besides myself that i didn't commit the crime, and my discovery only mentioned my name in one sentence "it was determined that i had purchased" (the rest was about an entirely different incident all together that i wasn't even evolved in). AND the charge was dismissed in court, would this be considered "false arrest" or "arrest without evidence" and would i be able to sue the police officer?

Police have qualified immunity from lawsuits. Unless they can be shown to be grossly negligent, you probably do not have a case. However, you should contact a civil rights lawyer and discuss your case with them. Good luck!

The advice of Mr. Case is exactly right. Contact a civil rights attorney; they will be able to help you.
