If amend chapter 7 schedule to add creditor, what all do I need 2 include. Will court give notice to creditor bc of amend matrix
Anonymous2 views2 answers
I want to add a creditor. I see there is a Central District of CA cover sheet for amendments and that there will be a filing fee.
1. If I amend the matrix, to I just type up the NEW creditor or do I need to redo the whole thing? Will the court send them notice because they are on an amended matrix?
2. Do I need to redo the Statistical Summaries because that will change with the new debt amount?
3. Correct me if I am wrong, I believe I need to send the new creditor a copy of the complete amendment by mail.
You are required to list ALL of your creditors on your bankruptcy petition. It is illegal, immoral and fattening to leave creditors out of your petition. It also endangers your discharge. So list them all.
1. When we file an amended matrix, we list them all. You can find them list on the the court's website and reprint them from a query at a cost of .08 per page.
2.Yes, you have to redo the Statistical Summary and also do an amended Declarations page.
3. Yes, you need to send a copy of all of this, except the matrix, to the new creditor or it's attorney.
Finally, you need to file a Certificate of Service with the court, so the court knows that you have served the new creditor. I believe that the Clerk of the Bankruptcy Court would have answered your questions for you in this matter. They can not give legal advice, but they can repeat the court's rules for you. So call the clerk when you get stuck. Lord knows clerks are used to stupid questions from lawyers. You may as well chime in. Good luck.

I just want to add to the previous response (see below):
1) When you add a new creditor, you must also send them the notice you received indicating your 341 Hearing. Make sure it is the copy that it includes your complete social security number (not the one with xx's).
2) When you add a new creditor, the Certificate of Service must indicate that you served them with the 341 Hearing notice with the complete Social Security number.
I hope this adds some added value.
Thank you.
