Under the Probate code, you can make a written withdrawal of your previous waiver of accounting. There is no form for this revocation of waiver of accounting. You, or your own attorney, can draft a letter or formal document, sign it, and send it to the estate attorney. This document should state that you are formally withdrawing your waiver of accounting. However, withdrawing your waiver of accounting will not speed up the completion of the probate. Once the revocation is made, the executor and the attorney will need to prepare an accounting. Probate ,by its very nature, is a lengthy process. There are various reasons why a probate can take some time to complete. In San Diego county, the local court rules require that a probate be set for a review hearing if the final accounting and report has not been filed within one year from the commencement of the Probate. Prior to the review hearing, an interim account or report must be submitted to the court. Many other counties in California have similar court rules.
