Currently i am working for employer A on H1b visa since aug 2007.My current employer doesnt want to apply for Green Card. Employer B is ready to apply for my green card for the future employment for the same postion. My question is Can my current employer file for my 7th year extension beyond 6 years limit if my PERM and I 140 is approved before 6 years? What documents my current employer has to submit in order to apply for 7th year extention under AC21?

If an I-140 has been approved and you are waiting for your priority date to be current, you can apply for a post-6th year extension of H-1B status. In addition to all of the regulation H-1B extension documents, your employer needs to submit the Notice of Approval of your I-140.

Yes, but for the 7th year extension, the PERM application must be filed before the beginning of the 6th year and must be pending for at least 365 days.
