What are the Washington State laws on a sibling getting guardianship of two young children.

Our mother is addicted to methamphetamine. As you can imagine, I am very concerned for the girls' safety and well-being. I grew up around it and I do not want them to face what I did as a child. My mother has already had her children taken away twice in the state of Washington. She cleans up and does the checklists just long enough for them to stop watching, then she goes back to her old habits and starts the cycle all over again. I am 23 years old and have been an active duty member of the Coast Guard for about two years now. I am ready and able to take custody of the girls, I just don't know what I need to do to get the state to actually take action. Please contact me and let me know what I can do.

Hello, A non-parental custody action may be filed if the petitioner alleges that the child is not living with the parents OR neither parent is suitable to look after the child. The laws are codified as RCW 26.10. The court has the option of starting a dependency action if appropriate. In making its determination, the standard is always the "best interests of the child" I am a Washington State attorney and can help you put together the paperwork to start the ball rolling, if you wish. To retain guardianship of a minor child, you must obtain approval from the child's legal parents and a court of jurisdiction in the minor's home state, and prepare an agreement outlining the details of the arrangement. Because each state has its own procedures and laws regarding guardianship of a minor, you should speak with an attorney and court clerk before drafting a guardianship agreement or attempting to keep a minor child out of the custody of her legal parents I can' t speak specifically about WA law.
