EIN Responsible Party

My husband and I are partners in an LLC. We are applying for an EIN and I'm wondering if it matters which one of us is listed as the Responsible Party. He is listed as the Registered Agent with the state, as it's mainly his company. He does video/film work and I do music/songwriting, but the company's main focus is his video work. I do all the bookkeeping, office work etc. and I would be the person to answer any questions the IRS may have. Thanks for your help.

If the limited liability company fails to pay any taxes, whether to the state or the federal government, the liability could attach to the person responsible for making the decisions regarding payments made by the LLC. Control of such decisions could make that person "responsible." A separate issue is the naming of the tax matters member of the LLC. It is that person to whom the iRS will look for answers regarding federal tax issues.
