What will happen if the driver who hit me only has bodily injury protection to 50,000 and my bills go above that?

I was injured in a auto accident. I saw a doctor for 3 months afterward, moved and now I'm going south health wise and need surgery to repair a disk and a bone spur from the accident. I will need two months off work, and have already used 20,000 in medical expenses with a lot more to accumulate especially since I now have scoliosis. Will I only get the 50,000 from insurance then wait on payments from the driver after suing. Or will the insurance company pay with him paying them directly

This situation illustrates why people need to purchase “UM/UIM” (uninsured/underinsured) coverage on their own auto insurance policies. A personal injury lawyer can help you determine whether there are any other avenues of recovery in your particular case.

There are too many unknowns to accurately answer your question. Once the at-fault driver's insurance limits are reached, then yes, the insurance company is not obligated to pay anything more. Hopefully you have under-insured motorist coverage. While you can try to collect directly from the driver, chances are he may not have the money needed to pay you just lying around to turn over. Get an attorney as soon as possible. Don't wait, these kinds of cases don't get better with age.
