I am filing a civil restraining order on my roommate, can my criminal record be used against me?

I have violent and abusive roommates, my girlfriend and I are filing civil restraining orders on our roommates because they make constant threats and have even physically attacked myself. I have a felony from roughly 3 years ago from an incident in another county. Will my roommates' lawyer use my criminal record against me?

A lot will depend on what type of felony you committed - from your statement I am assuming you were convicted, not merely arrested. A crime committed within 10 years is going to be considered by the Court and can't easily be evidentiarily excluded. I suggest you contact a local attorney to at least consult with before moving forward. The response given is not intended to create, nor does it create an ongoing duty to respond to questions. The facts of the current situation will govern. Past criminal convictions have limited use, under the rules of evidence.
