I was aressted in 2003 for felony retail theft and possession of a controlled substance. I served 13 days in county jail and given 2 years probation. I fufilled all the requirements of the probation but i did not have the money to pay my fines and they revoked my probation in August of 2005. I served 3 months in McHenry county jail. I have had only a few traffic tickets since. How long does this felony show up on backround checks for employers? Does the 2003 show up or the 2005 revocation?

Most states have specific statutes addressing how far back a civilian employer can see your criminal record. Most states go back at least ten to fifteen years for felonies, however, so a potential employer may be able to see this conviction on your record. Speak to the probation department that handled your probation case and ask them what will be visible to a civilian who requests your criminal history. They will be able to assist you. If not, then consider consulting with a local criminal defense attorney. Keep in mind that government entities, including police, prosecutors, and court personnel, will always be able to see the entirety of your criminal record.

In Illinois, this felony will appear on your record forever. However, you may file a petition for executive clemency asking the governor for a pardon with the ability to expunge. These petitions are granted in rare circumstances.

Unfortunately, felony convictions remaim on your record permanently; whether the later revocation shows up depends on whether the recod being referenced is your local, state or federal rap sheet.

A Felony is for life in Illinois. In limited circumstances a Felony can be expunged such as 710-1410 probation and some felonies may be sealed (Prostitution, Poss of Cannabis, PCS.) You may also petition for executive clemency but these petitions are rarely granted. Good Luck!
