You have posted this question a number of times. I have never seen or heard of someone being charged with aiding and abetting a DUI.

I have never heard of aiding and abetting in DUI/DWI cases in Florida. It would depend on how the statute was drafted and case law. If the statute said allowing someone who is impaired to drive was a crime and someone came up to you and said they were drunk and you let them drive that could be a problem. You would have a right to remain silent and the state would have to rely on a impaired drivers testimony that they told you they were drunk. The drier would also have a right to remain silent to prevent self incrimination. It is unlikely that the driver would want to cooperate and I would think it would be unlikely that the state would want to cut the driver a brake to get them to turn state and testify against you.
