A friend of mine had some legal issues and was sent to jail for several months, before she went she asked a court to let her parents keep her son while she was in jail and they were granted co-guardianship. But she does not fully understand what that means. So what exactly does that mean? Should she be able to keep her son with her or does he have to live with the grandparents? Does she have any rights to him?

In Illinois co-guardianship would mean more than one individual has been appointed by the court to work together as guardians for an indivdual who is either a minor or disabled. Guardianship in Illinois is available for the person and for the estate. When guardianship is granted for a minor the parent is still entitled to visitation with the minor child. The guardians would be responsible for the care of the child while in guardianshi, including where the child will live. In Illinois, a parent can petition the court to have a guardian discharged when they are able to assume the role as parent again.
