Can I sue for wrongful termination?

Business Questions 3 views 2 answers
A resident accused me of cursing her out. Another employer said I didn’t curse her out nor did her roommate hear such thing. Anywho, I was suspended because they said I abused an elderly person not because she said I cursed her out but because DON said I was explaining my story too loudly. I received phone call today that instead of suspending me, they were letting me go altogether because administrator had to report it to the state. I don’t understand how I can go from suspending to fired basically because I explained my story too loudly. I’m aware you have to take the residents side no matter what and I accepted my suspension but fired?

I am sorry to hear about your situation. If you are not a member of a labor union, then you are likely an at will employee. Absent illegal discrimination (age, race, sex, religion or national origin) or retaliation for assertion of a legally protected right (worker's comp, FMLA, etc.), an at will employee can be terminated for good reason, bad reason or no reason at all. If you believe you are the victim of illegal discrimination, then I suggest you speak with an employment law attorney who regularly represents employee as soon as possible. You must file a charge with the EEOC within 180 days of the last discriminatory act. I wish you the best.

I agree with my colleague. If you are a union member contact them immediately to get them involved, as you may have some due process rights attached to that representation. Otherwise, I would suggest following the previously given advice.
