Can probation time be shortened for expungement

2 views 2 answers
I was charged with a petty theft crime about a year ago when I was in college. Now that I have graduated I would like to get this expunged but my probation time is 3 years. Do I have to wait for my probation to end before I can get this expunged?

I suppose it depends on where you are. In CA, you can file a motion for early termination and an expungement, all at the same hearing.

Mr. Bruno is correct. I have done simultaneous motions to terminate probation early and expunge many times. The general rule of thumb (it is not a law, just custom) is that you need to have completed at least 1/2 of your probation before judges are likely to terminate early. If you had extraordinary reasons why it has to be done NOW, you might try earlier, but it would have to be good. LIke you got an offer of a fantastic job but have to be off probation to accept it. If you are in the San Francisco Bay Area, I could help you with this. Brian Dinday
