i have a Mr Brock calling me. His voice seems to have changed from the last call from them. He said he is calling from Robert James. I asked what it was for and he wants me to verify that he has the last four digits of my social right. I told him i don't give that info over the phone and he said he could not talk to me. He said there is a case pending towards me but will not tell me how much or from who. I told them to send me something in writing proving they had this and he said he didn't have to. I don't want to give my info over the phone what should i do? without the info he will not even give me an address to send a cease and desist letter. I couldn't find anything on the net about them.
This call is from a collector, and the collector wants to make sure they only speak with you about the debt. There is no court case because if there were, they wouldn't be calling you they would be delivering legal papers to you.
If someone that calls you refuses to provide a company name & address, and the name of the principal they are collecting for, you probably should just hang up on them. 'Hope this perspective helps.
At this point, without obtaining his business information, you should not give out your personal information. Like the previous lawyer indicated, if there is a pending "case" against you, you will get served with a complaint. If you continue to receive phone calls from this collection agency, it may be prudent to consult with a lawyer specializing in The Fair Debt Collection Practices Act (FDCPA) who will be able to stop the harassment. Good luck!
Thank goodness, you are a VERY wise person! I doubt you are being called by a debt collector. It's more likely someone is trying to steal your identity. If you have not checked your credit report in the last several months, or don't have a security alert on it, please go to annualcreditreport.com and pull your Experian report ASAP, to make sure no one is using your credit!
The other attorneys have given you good advice! NEVER GIVE YOUR SOCIAL SECURITY NUMBER OVER THE PHONE! or other information for that matter. Tell them to sue you if they want, and then you can deal with the local attorney and settle the case. If the attorney is calling you from outside of the state, he may be practicing law without a license and subjecting himself to disciplinary proceedings. Most of the collection agencies buy $100 worth of debt for $1 or less, and in most cases, do not have the backup legal documents to be able to prove you liable for the debt.
