My husband and i live in Texas and my husband's ex wife and 10 year old daughter live in North Carolina. He pays $500 in child support a month which was ordered when his ex lived in Orange County, Ca. She has now lived in Jacksonville, NC for four years. She will only let me husband see his little girl if we come to NC. We cannot always afford this so it limits us seeing her to about once a year. We would like to know what the standard out of state visitation is for North Carolina so my husband can request that and if she denies it he wants to take her back to court.

There is no "standard" per se. Each judge will consider the totality of circumstances and fix a visitation schedule that is appropriate under the circumstances. Having said that, in my experience, the norm for a "good father" is split Christmas, alternate Thanksgiving, award fall and/or Spring break and give a great deal of time in the summer (e.g., 4-7 weeks). Your husband should consult with an attorney in Onslow County. If you need help, let us know. www.RiceFamilyLaw.com
