Who is liable when a car is hit by an 18 wheeler on a right turn squeeze?

On a rainy day made a right turn while a truck on my left made the same turn and simply squeezed me, I was hopeless but eventually when the police officer got there I got the ticket for the accident. I believe its the big trucks fault, he knew I was on his right yet he continued as I wasn't there. I want to go to court to appeal, do I have a case?

You can have your day in court. Ask yourself: "Why would the truck continue if he knew you were there?" What would a reasonably prudent driver do, in either vehicle?

I would definitely fight the ticket. You may not win, but usually they will reduce the fine and/or the points, so it is worth it to plead not guilty and go to the hearing. At the hearing, you will be able to ask questions of the truck driver (assuming that individual shows-up--that will happen if you or more likely, the ADA sends a subpoena), and the police officer. Good luck.

This is a criminal question not a personal injury. You should talk to a traffic ticket attorney in WA. You may want to appeal and see if you can win the criminal case. You can always still bring the civil suit against the truck driver. This is a common accident with trucks.

You do not have a right to appeal until the underlying ticket has been adjudicated. I suggest that you retain an attorney who handles traffic ticket matters and have him or her represent you at a hearing on the ticket.
