Why doesn't DPS have record of my DWI conviction on 10/27/2010.

I was convicted of a Felony DWI last year. DPS has no record of the conviction as of today. My Texas driving record is totally clean. I do however, have DWI convictions on my driver's license in California within the last 5 years. This is causing a delay in getting my occupational. I've installed an interlock devise, sent an SR-22 to DPS, and paid my attorney to begin the process. She said nothing can be done until the conviction is on my driving record. In the meantime, I need to support my family by keeping my construction business going. All my attorney said I can do is wait. It's been over 7 months since my conviction. Is this common? What can I do to get the ball rolling?

If there is no record of the DWI conviction, why do you need an occupational? I understand that you might have lined up getting one in anticipation of being unable to drive (or did you get probation and it is somehow a condition of your probation?) If you want to force DPS to note your DWI your attorney could talk to the clerk of the court in which you were convicted and get the papers forwarded to DPS, or perhaps even forward certified copies of the DWI conviction to DPS to get the process started.

Hello there, The answer is really quite simple. DPS Texas didn't follow through with marking this against your drivers license. This sometimes happens. Sincerely, Erick Platten PLATTEN LAW OFFICE 304 WEST RUSK ST. TYLER, TEXAS 75701

You should be happy that the clerk of your felony conviction apparently didn't report your conviction to the DPS. This happens occasionally. Rejoice! If your license isn't currently suspended, you don't need an ODL (Occupational Driver's License). If it IS currently suspended, you can get an ODL immediately based upon whatever events caused you to be suspended. Your lawyer should understand this. If they don't, hire a new attorney, or have your lawyer call me and I'll explain it to him / her. phone 214-739-4515. Best of luck to you!
