So here in Florida I got a DUI and plead guilty and took the plea deal 180 days license suspension, 180 day probation, 1600$ fine, 100 hours community service, DUI School, and the Victim Impact Panel program...I am only into the first month of the sentencing but I am currenly getting kicked out of the house and need to move back with my mom in Indiana, so what happens if I just pack up and go? Will the cops come after me in another state? I can't wait 5 months till this thing is over living on the street...

I am not a FL attorney but this is an easy one -- you need to get back in front of your sentencing judge and ask him to move your probation to your new state. If you don't, your probation will get violated in FL, a bench warrant will issue for your arrest and your drivers license will be forever suspended until you take care of this. You will not be able to get a license in the new state. Call your probation officer and explain. Or ask your attorney to file a Motion.

Hello there, You need to explain your situation to your probation officer and see if the court will allow you to have your probation transferred. Sincerely, Erick Platten PLATTEN LAW OFFICE 304 WEST RUSK ST. TYLER, TEXAS 75701

Contact your probation officer and ask for permission to transfer probation to Indiana. You should also ask if you can move and report by mail. A violation of probation will most likely result in jail time, so keep in contact with your probation officer.

You cannot just get up and go. You need to contact your probation officer immediately and explain your situation. Your probation officer will have to move to modify your probation in court and the judge will have to approve supervision in Indiana. If you fail to do this, you will most certainly get violated by your probation officer and a warrant will be issued for your arrest in Florida for failure to appear at the violation hearing. If you are ever pulled over in Indiana, you run the risk that the Florida warrant will appear after a records check and you will be incarcerated and transported back to Florida. In addition, it will be very difficult for you to get a license in Indiana due to the unresolved DUI probation in Florida. Thus, my advice to you is to speak to your probation officer immediately.

The quickest way in Miami-Dade County is to have your lawyer, if you had one, file a motion before the Judge that accepted your plea. You should seek to have your probation modified to allow you to report by mail, if the Judge will or agree or transfer it to the new State. You can also ask to be allowed to pay off your community service hours, at $10 per hour or be permited to complete them in your new home State. I would also ask to waive the vehicle impoundment or have it done ASAP, before you move. If you did not have a lawyer or PD you should contact one to file this motion or call the Judge's judicial assistant to set down the motion yourself.
