Got to the nearest JP Court and tell them you want to file an action in small claims court. They will provide you with a complaint form and you fill it out, pay the filing fee and they will serve the other party. They will also give you a court date. You appear at the court date, tell your story to the judge and the judge will decide. Very simple. Very inexpensive. However, the limit of damages you can receive will be $5000.00 in Texas. That's the limit the court can award so if your damages exceed that, you should not file in small claims court.

You are certainly welcome to file a suit in small claims court, but have to be able to identify the other driver and have an address to serve papers. I think you say you didn't get the other driver's information. You should file a claim with your own insurance carrier. Check your policy, you may have uninsured driver coverage.
