Reckless Driving charge, how long are they on your record?
Anonymous3 views4 answers
I was going to school in SC in 2009. I got stopped by a cop at about 2 am. Admittedly I had a few drinks earlier in the night (5 pm stopped drinking). I got taken in for DUI, I didn't blow as I was always told not to (not sure if correct). I got a lawyer and my DUI was reduced to a reckless. I have since moved back home to NJ and was wondering how long the reckless driving offense would stay on my record, or if it ever comes off. I was looking at getting a job delivering products and wondering how this traffic offense is going to reflect on my job opportunity.

You would be best served by going to the MVC website and ordering a copy of your lifetime driver's abstract. Do not get the 5 year version. You will want to see everything that is going to show up on your driving record.

An out of State MV violation only caries 2 points in NJ. (reckless is 5 points if in State) So a 09 or 10 out of state violation should have been reduced to 0 points already. Check your abstract with DMV. Any violation stays on your record permentantly. I do not know exactly what the abstract will say about the out of state. Check that to.

The states are supposed to have reciprocity (communication with each other) regarding actions taken against a license out of state. That being said, the system is flawed and the information is not always transmitted. For the sake of argument, let's say that the reckless driving does appear on your NJ abstract. It will stay there forever. There is no expungement process or automatic "drop off" like there is for motor vehicle points. You can get a copy of your abstract from your regional MVC office.
