Can I get custody ?

I have my nieces baby placed in my home through Dcs on 6/26/19, because of drug use by mom. Since the placement the mom has failed drug test and now refuses to take the test. I filed for Emergency custody and was granted. When we went to court on 9/9/19 for temporary custody hearing, mom told the judge she was going to rehab the next day and to keep dcs's plan in place. The judge gave me a restraining order so mom can't remove the baby from me till court in November for temporary custody. Mom never went to rehab and now is all over the news for burglary of several stores in a mall on 9/13/19. I let dcs worker know about it but haven't heard back from her. Can I now get custody faster since moms crime is a felony? Any advice is helpful at this point!
