Hi, Im working on the affidavit of support for my mother. I am the petitioner but I am unemployed at this time, las three years I made money over the poverty line. I just got married last december, but my husband income is not enough, because i have two kids of previous marriage. We rent a room in my sister house whose willing to b the sponsor, now I dont know if she should fill the i864 or I864a, cuz even if we live under same roof we dont wanna combine incomes, cuz she also has a families so we are 2 different families. Whats the best way to go? She and her husband make around 70000 a year and his family number is 4?

Your sister can definitely add in their income. The question here is whether they are considered part of the "household" so that they can sign an I-864A contract with you (adding their income to oyur affidavit) or - since you rent from them - they are considered a separate household needing to complete their own, separate I-864. My suggestion would be to complete a separate one, just because this is safer. See the link below for a guide, and speak with an attorney.

Sounds like filing a separate I864 would be the best avenue. Have her supply all the pertinent evidentiary documents she has as to income and that should suffice.

You complete as the sponsor and she and husband as household members. You still need to complete the affidavit of support. If you are not familiar with the immigration process or otherwise have concerns with your case, retain an immigration lawyer to assist you. Goodluck.
