MY HUSBAND WAS ARRESTED IN EARLY MARCH FOR DOMESTIC VIOLENCE. HE HAS COURT JUNE 8TH AND I HAVE BEEN SENT SUBPOENA TO APEAR IN COURT TO TESTIFY FOR THE STATE OF NEVADA AGAINST HIM. SINCE THE INCIDENT MY HUSBAND MOVED OUT BUT HE HAS AGREED PAY THE RENT AND BILLS UNTIL I FIND A JOB TO SUSTAIN MYSELF AND MY 2 CHILDREN. I HAVE A 8 Y/O SON WITH AUTISM AND A 2 Y/O DAUGHTER, IF HE GOES TO JAIL HE WILL LOSE HIS JOB AND MY CHILDREN AND I WILL END UP HOMELESS. I DONT KNOW WHAT TO DO, I KNOW HE NEEDS HELP AND ANGER MANAGEMENT COUNSELING. I DONT WISH FOR HIM TO GO TO JAIL, WILL TALKING TO THE D.A'S BEFORE THE COURT DATE HELP?
In Nevada, the typical penalties for battery-domestic violence are:
Two to 10 days in jail (which can usually be converted to community service),
48 to 120 hours of community service,
a fine of $200 to $1,000 (plus a $35 administrative assessment fee), and
domestic violence counseling for at least 1 ½ hours per week for six to twelve months at the patient’s expense.
Prosecutors will seek to minimize further harm to the victims of the crime and will likely consider your wishes in crafting a plea bargin. For more information and assistance, you may wish to contact the Clark County Victim-Witness Assistance Center (VWAC).
