General outcome for tampering w/ motor vehicle?

My boyfriend got 5 years probation in 2006 for tampering w/ motor vehicle, he was 17 at the time, now 22. His probation has been suspended due to some violations, most of them drug related. A warrent was issued for him and now he is in jail awaiting his court date. There was talk of him having to to a 120, but other than that we're clueless as to what the outcome of his court date might be. Any idea of what might happen?

The outcome of your boyfriend's case will depend on several factors. If he was on probation for tampering in the first degree it is a class C felony. The range of punishment if his probation is revoked could depend on whether he received a suspended imposition of sentence where the maximum punishment of up to 7 years in the Department of Corrections is available to the Court upon revocation. In the alternative, he may have received a suspended execution of sentence with a specific term of years that was suspended when he was placed on probation. If he is sentenced pursuant to Section 559.115 for a term of 120 days he could be released at that time to complete the remaining term or probation or a new five year term of probation if given by the Court. As you can see, the outcome depends upon the specific facts of your boyfriend's case.
