Can I take action against unethical employer?

Business Questions 2 views 1 answers
One week ago, my company attempted to to suspend me for breaching a policy that did not exist. Two weeks prior they had paid me over a week late. Another employee left me threatening notes and took my personal belongings. This company did not investigate my fellow employee harassing me. After promptly resigning, they are now attempting to say I was terminated rather than stating that I resigned. I am aware of at will employment, but it seems that late payment and refusal to investigate harassment is illegal. Can I take action against them?

I'm sorry that you are having problems with your employer, but I don't see anything illegal here. If another employee was harassing you in a way that wasn't sexual harassment, then the employer isn't legally responsible for it. They may have actually done you a favor as it's much easier to get unemployment benefits when you are terminated, then when you resign for good reason. If they try and deny your benefits and claim you were fired "for cause," they will have to prove the policy and that it constituted a severe breach. Otherwise, there really isn't a legal case yet against them, nor will there be.
