I want to move 33 miles away with my children to my home town can I change their school district?

Business Questions 2 views 1 answers
In our divorce paper work I agreed at the time to move to my ex husband's home town and have the children start school there. We have 50/50 but I have primary placement during the school year. I had to quit my full time job in order to stay home and care for the kids and get them to school as needed because there isn't care available for them here. I want to move back to my home town where there are more job opportunities and my family is available to help me with drop off and pick up times for school. Since I have primary placement during the school year what steps do I need to take to notify my ex of the move?

If you have joint legal custody, you cannot change schools without your ex’s consent. Since you are not moving more than 100 miles away, you can move, but you will be expected to follow the court orders on current placement, including pick up and drop offs. If your moving away means that you will not be able to follow those court orders, before you move, you would heed to file a motion to modify those orders. If this is a Wisconsin case, there is also a prohibition on either party filing a motion to modify custody or placement for 2 years from your initial orders, unless there is a showing that your children are in imminent danger.
