Anonymous2 views3 answers
Bumper to bumper Traffic I was on a middle lane highway and my foot was on the brake pedal the whole time and has well the car in front of me too we both were still and then the car that hit me from the back which led us to hit the guy in front of us which totaled his vehicle that was in front of us and the guy who hit me from the back which cause this whole accident did admit to fault and police did come and we have a police report
can the guy in front of us sue me for any injuries or anything? If the guy behind me causes this whole accident? And admits to faults
Follow my colleagues advice and notify your insurance company about the lawsuit. They have an obligation to defend you. They will assign an attorney to defend you who can focus on the driver who hit your car as being the party responsible for the harm.
Can you be sued? Certainly. In general, you anyone "sue" anyone and everyone he or she wants in this country so long as you can afford the requisite filing fee.
That does not mean, however, that you will be sued or that a jury will agree that you had any liability in this accident.
In addition, if you are sued and had an auto insurance policy that was in force at the time of the accident, your insurance company will indemnify and defend you up to your liability policy limits.
You will immediately need to forward the Summons and Complaint and any other attached legal paperwork to your insurance adjuster. I would send it via overnight express mail, fax, or e-mail (and keep a copy for yourself) and then follow up via telephone the next day to ensure the adjuster has received the paperwork.
Your insurance company will then assign a defense attorney to you, so you will need to keep in touch with both your insurance adjuster and the attorney it will assign. The attorney assigned will answer any questions related to the lawsuit that you may have.
Also, if you were injured, your best bet to obtain the maximum injury settlement amount in this case is to consult immediately with an attorney in your area to obtain a more specific answer and get all of your legal options before deciding what to do and then also complete all medical treatment necessary for any injuries you received. The attorney will also investigate any liability issue and check for all available coverages to ensure you have the maximum amount of coverages available to you. You may have some coverages on your own auto policy as well that can assist you. You can use the "Find a Lawyer" link at the top of this page for the names of attorneys in your area. Most offer a free consultation and work on a contingency fee basis, so you won’t have to pay anything up front.
Please do not message me for further advice or call my former law firm if you have any further questions. If you are in need of an attorney to assist you, please search for another attorney in the jurisdiction involved in your case, as I am now retired, and my former law firm is no longer handling these types of cases. I am active on and answer questions only as a public service at this point.
IMPORTANT: No attorney-client relationship is formed through interaction with this attorney on this public forum. The contents of any comment or response should be considered general conversational discourse on the topic identified and NOT specific legal advice or analysis that might apply to your situation. If you rely upon any part of the content of this response in making any decision or pursuing any course of action, you do so at your own risk and without recourse against this attorney or law firm.
Good luck!
If you were injured as a result of the impact behind you, then get medical assistance ASAP and contact a personal injury attorney to see what are your options and to assist you in reporting the accident.
If you were not injured, then report the claim to your insurance company. So long as you were pushed into the car in front (as opposed to hitting the car in front and then the car behind you hitting you and pushing you into the car in front a second time), then you should not be held responsible. Let your insurance company know that there was only one impact (which should be recorded on the car's data recorder if anyone bother's to check) and then let them handle any claim from anyone against you.
