I havnt been convicted yet but I’m very nervous it may happen ..my account says I’ve committed unemployment fraud ..I’ve started paying the money down as much as I can every week ...I’m very nervous on getting indicted and facing jail time over this ..I’ve never really been in trouble with the law and if this did happen I’d lose everything so I’m very scared ..I plan on having all the money paid back 100% within a couple weeks ..my question is will I still be charged or indicted if I pay back the money ?
That can be very tricky to answer, because you don't state the amount. Last year most of the cases prosecuted in the BMC were under $18k, and over that many were indicted by a grand jury for amounts ranging $22k to $45 k. If you over collected and the sum is less than $10k AND you are paying it back they may not charge you criminally. Larceny has a 'permanent intent to deprive the owner' element to it, and if you are paying it back then they cant prove intent to deprive. If you are getting it all paid back then you are less likley to be criminally charged. However, if you are contacted by any investigators from DUA or teh AG's office it would be the smart move to get a lawyer involved and Not speak to anyone without a lawyer.
You are jumping all over the place so it is hard to understand you. Your best bet is to retain and consult with the criminal defense attorney. For all the issues can be raised and discussed. Good luck
