Did the Officer drop my drinking citation?

Long story short, I was at a college tailgate with 21+ friends. Campus police stopped by and asked for everyone's IDs. I had 1 White Claw and blew a 0.04 when he breathalyzed me. I was honest and was the only under 21 person there. It was the campus police, as well as officers from the Bureau of Alcohol (I think) and I was given a citation. I was told I'd have to meet with the Dean of Students office to satisfy the school requirement and appear in court. I got an email from the school promptly Monday morning and have not received any lawyer letters. That was mid-November, and I've completed everything with the school. Oddly enough, my name does not appear on the court lookup tool, and when I called the courthouse the woman said it was very odd that it still wasn't in there almost a month later and there was no record of it at all and to keep calling back and checking on it. I turn 21 in 4 months and he checked me again and I blew a 0.03. Is it possible I got lucky and the officers dropped it bc the breathalyzer reading was so low and wasn't worth it? Maybe because it's also my first offense or they might have felt bad when they saw me crying afterward? I'd appreciate any help!

Maybe you shoukd lol at the citation you received to see if your name is spelled correctly; that your middle name isn’t shown as your first or last -those are the sort of things that can cause a mis-file. You can also call the clerk’s office and give them the citation number and ask them to check. You should also check k the date and time you are to appear in court : that will be on the citation and your case will likely be set in courtroom 1130 of the Neck Co Courthouse. . Sounds like Meck Co ABC (alcoholic beverage control) cops were working with campus police.

It may be a misplaced citation, but it could pop up and cause and order for arrest at some point in the future. It is encouraging that it has not been turned in. However, I would recommend speaking with a lawyer to take advantage of this situation. Most of us offer free consultations. Brandon Roseman Charlotte Criminal Defense Lawyer
