Surviving Parent giving consent to a family member for custody (child lives in a different state)
Anonymous5 views2 answers
My son recently lost his mother and as the biological father I have the full custody now. He lives in a different state so I have signed (legally) a consent for his grandfather to share custody ( as he lives with my son). Now a prosecutor sent a letter to his grandfather asking if they know of my whereabouts (since he applied for medical benefits for both of them). My child’s mother always claimed she didn’t know where I was ( although I have always been present in my sons life). I cannot bring my son to live with me at the moment but I have always paid childcare consistently. But I am wondering what are the repercussions of lying (in regards not knowing my whereabouts). I live in VA and my child lives in OH
I am actually licensed in both States although inactive in Ohio. Years ago when I volunteered for court appointed work, I did represent persons charged with felonies for lying on government applications regarding the other parents whereabouts. Also if the non-custodian parent knew about the fraud he/she and was part of it, he/she can be charged with felony and held responsible for back payments. Perjury is a Class 5 felony in Virginia. § 18.2-434. If OH prosecutors are checking, then there might be some Fraud charges pending when mother applied for benefits based on false info. Check with OH state lawyers.
