My daughter is 8years old and mom got a owi 1st offense with my child in the car with her and 2 more kids. My daughter told me her mom ran a stop light and the police stopped her. her mom went to jail and my daughter stated that she had to carry her 2 year old disabled sister home while walking with her 6 year old brother and was home by herself until her mom got out of jail. I asked why didnt you and your brother and sister go with the police she stated "mommy told me to get them and run home and stay" then gave her the keys. I then asked where was the police when you walked. she said they did not see them. Now I wondering how did the police not see 3 kids in the car with her or see them exit the car while doing a breathalyzer. when she got stopped why wasnt I notified. The mom got her license suspended for 7 months and have a ignition lock on her car and do classes and some more things. she neglects her doesn't let her spend time with me that's court ordered with me. my daughter tells me when I do see her can I please take her from there she's in fear for her life. She eats once a week she repeating 2nd grade again due truancy. It more to the story the list goes on

You need to file a motion to have placement of your children awarded to you and the mother to have restricted and/or supervised placement. You may want to try an emergency ex parte motion for the court to give you interim emergency placement pending the court date.

The mother may have a serious problem with alcohol.. Although this is only the first offense, her other conduct sounds as though it is harmful to the children's best interests. You should file a Motion for Modification of Placement.

You would file a motion to modify the current legal custody and physical placement, and potentially a motion for contempt if mom is not following the current order. If you believe the children are currently in danger, you might also contact child protective services.
