Anonymous2 views1 answers
ORIGINAL QUESTION:
My priority date is March 2007 and my 140 and 485 was applied together in August 2007. I received my 140 approval in June 2008. I am working for the same employer on H1B. I want to change jobs since i have a good job offer and start using my EAD. Am i safe to use my EAD and change jobs? If not then what are my risks? Please advise?

While you may be eligible to change jobs and work with your EAD, there are certain considerations you must take into account with regards to your continuing eligiblity with respect to your I-485 application. Depending on your prefence category, whether you are EB-2 or EB-3 and the visa bulletin, you may be eligible for an H-1B extension (if that is your current status), even if you have used up your 6 years. In addition, you should be careful about changing jobs at this point (i.e., you should stay at a job in the same field for which you were sponsored). There are several factors to be considered with regards to changing jobs at this point, and you should seek the advise of an immigration attorney to discuss your best course of action.
