I live in NC, if subpoenaed as a witness in a DUI case do I have to go to court?

A girl I know had too much to drink and ran into my car. Someone called the police and they arrested her for a DUI, now I have been subpoenaed to go to court. Can I get in trouble if I do not show up?

Yes you could be. A subpoena is an order by the court for you to appear. If you fail to appear a bench warrant may be issued for your arrest and you may be charged with a crime (the actual crime name varies by state, but the basic idea is contempt of court for failure to perform the order.)

A subpoena is a court order, so if you do not attend, you are violating a court order. My standard disclaimer: I am not offering legal advice, assume I do not know the law in your state and that I am just making suggestions for starting points for when you do speak with an attorney. Do NOT rely on anything I write and contact a lawyer in your area immediately after reading my posting.
